This instrument delineates the Terms and Conditions (the “Terms”) that shall govern access to and utilization of the social media service rendered by ParentsJoint.com (hereinafter, the “Service Provider”), which includes, but is not limited to, all associated content, functionalities, and features (the “Service”). Access to or utilization of the Service constitutes an unequivocal assent to be bound by the provisions of this instrument, and it is hereby established that a legally enforceable agreement is created between the Service Provider and the user, effective upon the initial interaction with the Service.
1. Acceptance of Terms
The utilization of this Service is predicated upon the acceptance of and absolute compliance with these Terms, inclusive of all subsequent amendments and modifications that may be implemented from time to time. The continued access to or usage of the Service, subsequent to the effective date of such revisions, shall be construed as a definitive and binding acceptance of the entirety of the updated instrument. In the event of a dissent from any provision contained herein, access to the Service is expressly proscribed, and any continued use shall be deemed a material breach of this agreement.
2. User Accounts and Responsibilities
Access to this Service is constrained to those natural persons who have attained the age of eighteen (18) years. The establishment of an account affirms that the requisite legal age to enter into a binding contractual agreement within the Republic of India has been attained and that all information provided during the registration process, including but not limited to demographic and contact data, is accurate, complete, and current. Furthermore, sole responsibility for the security of an account password and for all activities or actions that transpire under its authority, whether authorized or unauthorized, shall be borne by the account holder. Any unauthorized use or suspicion of a security breach must be reported to the Service Provider immediately.
3. Submission of User Content
Exclusive liability for all content, inclusive of but not limited to text, photographic media, video files, and other materials, submitted, uploaded, or otherwise made available on the Service (“User Content”) is assumed by the user. The submission of any User Content that is defamatory, obscene, or that contravenes any prevailing law or the rights of any third party is prohibited. By submitting User Content, the user hereby grants the Service Provider a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any form, media, or technology, whether now known or hereafter developed, for the purpose of operating, promoting, and improving the Service. The user warrants that they possess all necessary rights and authority to grant the aforementioned license and that their User Content does not infringe upon the intellectual property or proprietary rights of any third party.
4. Prohibited Activities
Users are expressly prohibited from engaging in the following activities, the commission of which may result in the immediate and permanent termination of an account:
- The contravention of any and all applicable Indian laws, including, but not limited to, the provisions of the Information Technology Act, 2000, and its subsequent regulations.
- The engagement in any activity determined to be illicit, fraudulent, or demonstrably detrimental to other individuals, encompassing acts of harassment, stalking, or the promotion of violence or hatred.
- The dissemination of misinformation or the propagation of demonstrably false news, particularly when such content is of a nature that could incite violence, public disorder, or cause demonstrable harm to an individual or group.
- The impersonation of any natural person or corporate entity with the intent to deceive or mislead others.
- The transmission of computer viruses or other forms of malicious code designed to disrupt, damage, or interfere with the normal operation of the Service or the data of its users.
- The infringement upon the privacy of other users through the unauthorized collection, storage, or distribution of their personal information.
- The engagement in any form of automated data harvesting, web scraping, or the systematic collection of data from the Service without the explicit written permission of the Service Provider.
5. Compliance with Indian Legal Frameworks
This Service is rendered for the exclusive utilization of entities or natural persons domiciled within the Republic of India. Utilization of this Service is contingent upon strict adherence to all applicable local, state, and national laws within India. The Service Provider is committed to upholding its obligations as an intermediary under Indian law and shall cooperate fully with all duly authorized law enforcement and governmental bodies.
- Information Technology Act, 2000: The provisions of the Information Technology Act, 2000, and its subsequent amendments, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, shall be complied with. It is recognized and accepted that, in the capacity of an intermediary, a due diligence is required to be exercised, which may necessitate the removal or disabling of access to specific content upon receipt of a valid and formal order from a governmental authority or a competent court of law. Such content takedown procedures will be implemented with due regard for legal mandates and in accordance with the timelines specified under the rules.
- Digital Personal Data Protection Act, 2023 (DPDP Act): The processing and handling of personal data are governed by our Privacy Policy, which is structured in full compliance with the DPDP Act. Utilization of this Service constitutes a formal assent to the collection, processing, and utilization of said data as delineated within our Privacy Policy. The Service Provider shall ensure that all data is processed in a manner that is lawful, fair, and transparent, and shall only retain such data for a duration that is necessary for the fulfillment of the purposes for which it was collected.
- Grievance Redressal: Pursuant to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, a designated Grievance Officer has been appointed to address user complaints. The contact information for this officer is provided in the Privacy Policy. A formal grievance mechanism is in place to facilitate the timely and effective resolution of complaints related to violations of these Terms or any applicable laws.’
6. Intellectual Property
The Service and its original proprietary content, features, and functionalities, including but not limited to software, graphics, logos, and trademarks, constitute and shall remain the exclusive intellectual property of ParentsJoint.com and its licensors. The user is granted a limited, non-transferable, non-sublicensable, and revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms. No rights or licenses are granted to create derivative works from, reproduce, reverse engineer, or otherwise exploit the intellectual property of the Service Provider without explicit prior written authorization.
7. Termination of Service
The unilateral right to terminate or suspend an account immediately, without prior notification or liability, is reserved for any reason whatsoever, including, without limitation, any breach of these Terms. Upon the termination of an account, the right to access and use the Service shall cease immediately. All provisions of these Terms which, by their nature, should survive termination, including, without limitation, provisions regarding intellectual property, indemnification, disclaimers of warranty, and limitation of liability, shall remain in full force and effect.
8. Disclaimer of Warranties
The Service is rendered on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. The Service Provider does not warrant that the Service will be available without interruption, secure, or free from errors. Furthermore, no warranty is extended regarding the accuracy, reliability, or currency of the content contained therein.
9. Limitation of Liability
To the maximum extent permissible under Indian law, under no circumstances shall ParentsJoint.com be held liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses, resulting from access to or utilization of the Service. The Service Provider’s total aggregate liability arising from or in connection with these Terms shall, in all events, be limited to the amount paid, if any, by the user to the Service Provider for the use of the Service during the six (6) months immediately preceding the event giving rise to the claim. This limitation applies irrespective of whether the claim is based on warranty, contract, tort (including negligence), or any other legal theory.
10. Governing Law and Jurisdiction
This instrument and its provisions shall be governed by and interpreted in accordance with the laws of India, without regard to principles of conflicts of law. A submission to the exclusive jurisdiction of the courts located in Kolkata, West Bengal for the resolution of any and all disputes arising from these Terms is hereby agreed upon.
11. Modifications to Terms
The right is reserved to amend or substitute these Terms at any time. Notification of such modifications shall be provided by posting the revised Terms on this page. The continued access to or utilization of the Service subsequent to the effective date of said revisions shall constitute an acceptance of and agreement to be bound by the revised Terms. It is the user’s responsibility to review these Terms periodically to remain apprised of any and all modifications.

This policy serves as a foundational covenant between the Service Provider and all Data Principals, elucidating the framework of data rights and obligations.
The utilization of the Service constitutes an affirmative and unambiguous assent to the collection and processing of data in accordance with the principles set forth in this policy. It is incumbent upon all users to review this instrument periodically, as its provisions may be subject to amendment without prior direct notification.
1. Data Collection
The collection of various categories of data is undertaken for the express purpose of the provision, enhancement, and sustainment of the Service. The collection of said data is guided by principles of necessity and purpose limitation, ensuring that only information requisite for the fulfillment of a specified purpose is acquired.

- Data provided by the user: Upon registration for an account, the collection of a name, electronic mail address, telephone number, connection with neurodiversity, Country, State, City, and date of birth may be undertaken. - User-generated content: The content generated, uploaded, and posted by users, including, but not limited to, photographic media, video files, textual entries, and comments, is collected. This content may contain personal data and is processed in a manner consistent with the nature of the Service as a social platform. The processing of such content is essential for its display, distribution, and archival on the Service.
- Usage Data:
- Information concerning the utilization of the Service is automatically collected through electronic means. Such data includes, but is not limited to, the Internet Protocol (IP) address, browser type, pages accessed, duration of sessions on pages, and device identifiers. This data is non-personal in nature and is aggregated and analyzed for the purpose of improving the functionality, performance, and user interface of the Service. 3. Data Sharing and Disclosure
The disclosure of data to third parties may be executed under the following circumstances, with a steadfast commitment to minimizing such transfers to a scope that is strictly necessary for the fulfillment of the purpose:

4. The Rights of the Data Principal under the Digital Personal Data Protection (DPDP) Act
As a “Data Principal” under the DPDP Act, the following rights are conferred:
- The Right of Access: The right to solicit access to personal data held by this entity is conferred. This includes the right to obtain a summary of the personal data being processed, an account of the processing activities, and a copy of the data itself.
- The Right of Correction and Erasure: The correction or erasure of personal data may be requested if said data is inaccurate or no longer requisite for the purpose for which its collection was initially undertaken. Requests for correction shall be addressed promptly and with a high degree of precision, while requests for erasure shall be evaluated against the legal necessity for data retention.
- The Right of Grievance Redressal: The right to a readily available and effective mechanism for the redressal of any grievance pertaining to an act or omission by the “Data Fiduciary” (the Service Provider) is conferred. This right is fundamental to the framework of data protection and ensures a clear channel for the resolution of disputes.
- The Right to Withdraw Consent: The right to withdraw consent for the processing of personal data at any time is conferred, in which event the provision of certain services may no longer be possible. Such withdrawal of consent shall not affect the lawfulness of any processing undertaken prior to the withdrawal.
5. Data Security
Reasonable security practices and procedures, as mandated by the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, have been implemented to safeguard personal data from unauthorized access, loss, or misuse. These measures encompass both physical and electronic safeguards, including encryption, access control protocols, and regular security audits. However, no method of transmission via the Internet or electronic storage can be guaranteed as entirely secure. The Service Provider shall not be held liable for security breaches beyond the scope of reasonable diligence.
6. Grievance Redressal
Inquiries or grievances concerning this Instrument of Governance and Privacy or data practices may be submitted to the website through the “troubleshooting” page. An acknowledgment of a request shall be provided within twenty-four (24) hours, with a subsequent resolution to be administered in accordance with the provisions of the DPDP Act. Should the Data Principal remain dissatisfied with the resolution provided, a formal complaint may be filed with the Data Protection Board of India, as per the established legal process.
7. Amendments to This Privacy Policy
This Privacy Policy is subject to amendment at any time. Notification of any such modifications shall be provided by posting the revised policy on this page. The continued utilization of the Service subsequent to the effective date of said revisions shall constitute an acceptance of and an agreement to be bound by the revised provisions. The Service Provider shall endeavor to provide prominent notification of all material changes to this policy.
